Electronic discovery (ediscovery) refers to the process where an organisations (or individuals) electronically stored data is identified, located, preserved, analysed and subsequently produced with the intent of using it in either civil or criminal proceedings.

To be sure that you or your company is ready for such proceedings and can respond to ediscovery requests you should have pre-defined policies and procedures already in place regarding data storage, backup and deletion. In other words a clearly defined record management policy should be in operation throughout the company for litigation preparedness before any ediscovery request is made. Such policies should include how your organisation will respond to any ediscovery request.

Failure to have these record management policies in place leave you or your company vulnerable to being unable to fully comply with ediscovery requests or orders made by the Court. This in turn could result in subsequent financial loses and a being unlikely to win any litigation you might be involved with.
