| What is ediscovery |
Electronic discovery (ediscovery) refers to the process where an organisations (or individuals) electronically stored data is identified, located, preserved, analysed and subsequently produced with the intent of using it in either civil or criminal proceedings.
To be sure that you or your company is ready for such proceedings and can respond to ediscovery requests you should have pre-defined policies and procedures already in place regarding data storage, backup and deletion. In other words a clearly defined record management policy should be in operation throughout the company for litigation preparedness before any ediscovery request is made. Such policies should include how your organisation will respond to any ediscovery request.
Failure to have these record management policies in place leave you or your company vulnerable to being unable to fully comply with ediscovery requests or orders made by the Court. This in turn could result in subsequent financial loses and a being unlikely to win any litigation you might be involved with. |

| Do I need a Computer Forensic Investigation for every ediscovery request ? |
Clearly every case and organisation is unique and will have different needs. In many cases there will be no need to use the services of a company such as ours. The data required may be clearly and easily identified and processed.
However there will also be cases where our expertise in data recovery and many years of experience in data analysis may be able to identify where additional data may be found that might be crucial to our case. Data that you or your system admin may be unaware is kept by the operating system. Many pieces of data are stored by an operating system that a user never sees or has access to that may well assist in proving or disproving a crucial point in the case.
As an example we may be able to identify the exact make and model of a thumb drive and date it had been plugged into a USB port on a computer. In a case where confidential data has been stolen by an employee this may be vital information.
